Up In The Air / Re: Mask Exemption on Jet Blue
« on: August 18, 2021, 11:19:09 AM »
OK thx for for the info, but it does matter since if The Feds dont require a face mask then JB shouldnt , could be they are allowed to, I dont know but I would assume they would have to accept what The Feds hold as The Law, But the main thing is where an Autistic person ( be it an adult or child) fall under The Disabilities Act and The CDC rules, and why I said to call both and find out before going after JB or making another booking

Hope things workout for you and one way or another you're able to do the trip with your child

Hope some of this can be of help:

1- Jet Blues policy had you clicked on Covid-19 Info HUb; (the last sentence is important and works against you)  The mask is not an ask.

Federal law requires masks to be worn by all travelers 2 years and older at all times throughout the flight including during boarding and deplaning, and in the airport. Any individual who fails to comply with this law may be subject to denied boarding, removal from the aircraft and/or penalties under federal law.
More on mask requirements.

Mask must be worn properly, to cover nose and mouth.
Masks with vents or exhalation valves are not permitted.
Plastic face shields may be worn in addition to a mask but not in place of one.
If conditions on board a flight necessitate, masks should be removed to accommodate the placement and wearing of oxygen masks.
Customers with conditions that prevent them from wearing a mask should consider postponing travel.

Also no where does it say a Face Shield is OK w/o a mask most carriers say its NOT could be in your childs case it will be.

That said AA is the opposite:  Face coverings Expand

U.S. federal law requires that you wear a face covering at all times while indoors at the airport and on board your flight If you refuse to wear one, you may be denied boarding and future travel on American. You may also face penalties under federal law.

These rules do not apply to children under 2, or if you have a disability that prevents you from wearing a face covering and meet the exemption requirements.

Visit the Centers for Disease Control and Prevention (CDC) website for more information about the mask requirement.

Requirement for face masks on planes and in airports Opens another site in a new window that may not meet accessibility guidelines.

You should bring your own face covering to use while traveling. While limited quantities of face coverings may be available at the gate, they will not be available for every customer on every flight.
Acceptable face coverings

A mask or 2 layered secured cloth that completely covers your nose and mouth and fits snugly to the sides of your face and under your chin
Face shields worn with a face covering, but not in place of one

But the above assumes that the CDC or some Fed Dept includes a person with Autism I personally dont know if thats considered a good enough reason

Lastly the CDC: Disability Exemptions of the Order

Who is covered by the exemption for “a person with a disability who cannot wear a mask, or cannot safely wear a mask, because of the disability as defined by the Americans with Disabilities Actexternal icon (ADA, 42 U.S.C. 12101 et seq.)”?

Most people, including those with disabilities, can tolerate and safely wear a mask and are required to wear one as per CDC’s Order. However, certain people with disabilities who, because of their disability, cannot wear a mask, or cannot safely wear a mask, are exempted from CDC’s mask-wearing requirement.

The exemption is not meant to cover people with disabilities for whom wearing a mask might only be difficult or whose disability does not prevent them from wearing a mask or wearing a mask safely.

The following narrow subset of persons with disabilities are exempt from CDC’s requirement to wear a mask:

A person with a disability who, for reasons related to the disability, would be physically unable to remove a mask without assistance if breathing becomes obstructed. Examples might include a person with impaired motor skills, quadriplegia, or limb restrictions
A person with an intellectual, developmental, cognitive, or psychiatric disability that affects the person’s ability to understand the need to remove a mask if breathing becomes obstructed

The following persons with disabilities might be exempt from CDC’s requirement to wear a mask based on factors specific to the person:

A person with a disability who cannot wear a mask because it would cause the person to be unable to breathe or have respiratory distress if a mask were worn over the mouth and nose. A person with a condition that causes intermittent respiratory distress, such as asthma, likely does not qualify for this exemption because people with asthma, or other similar conditions, can generally wear a mask safely.
A person with a disability requiring the use of an assistive device, such as for mobility or communication, that prevents the person from wearing a mask and wearing or using the assistive device at the same time. If use of the device is intermittent and the person can remove the mask independently to use the device, then a mask must be worn during periods when the person is not using the device.
A person with a severe sensory disability or a severe mental health disability who would pose an imminent threat of harm to themselves or others if required to wear a mask. Persons who experience discomfort or anxiety while wearing a mask without imminent threat of harm would not qualify for this exemption.

Now could be JB cant disallow what the CDC allows, if you find you child qualifys for the exemption, I still wouldnt fly with JB simply since the flight crew might not be up on it nor for your return. I would book with a Carrier like AA that has it plain and simple that they acknowledge that there are exceptions or any other Carrier that has this as their guidelines. Seems you are going for Yom Tif and the last thing you need is for a Capt to off load you and now you wont make it

I would quote JB The CDC rules if they in fact apply to you and thusly tell them they are not upholding US Law and to avoid a nasty PR issue and suing for the refund, they should simply tell PL to issue you a full refund.

Then do yourself 1 other favor dont book via any 3rd party site, book direct with the carrier, you dont need problems the day of travel and the carrier will tell you, you have to deal with the agency you purchased it from

If your child doesnt fall into the CDCs exemption area then forget about flying, if you arent sure call The CDC tomorrow or the Agency for Disabilities before calling Jet Blue or book another tkt

Wish I could help you out more , I hope the above helps you to get a Refund from JB and in finding which if any carrier you can fly with

Either way fill out a complaint with DOT if you child falls into the Exemptions so that they can  let JB know they have to accept some one who is Exempted but only do so after knowing they are Exempt (not that it makes sense they should be) and calling JB and letting them know that and thusly a full refund is due you

If you are still head strong about still flying with JB, bear in mind that if their website doesnt acknowledge there are exemptions most likely the ground crew and plane crews wont either, and I highly doubt that even if they agree with you that they messed up that it will reach all their employees 1-2-3 and it time for your trip. But that choice is up to you

I don't think anyone can listen as carefully as you @steve2 you must have superhuman listening powers.

And I'm so happy you use it for good.

I really don't know how I could go on if you didn't spend 30min+ of your day listening so carefully to the lawyer. And then posted your thoughts here.

I really appreciate the good you do. Thank you.

Please continue to use your superhuman listening powers for good.

Eta: Like the overflowing compassion you display for a family with an autistic child.

Cut the B, before anyone claims something was done due to a person being  Anti-Semitic they better know for sure that was the reason , my point was simply that as the facts now stand that wasnt the reason for them being thrown off to begin with! Dan is correct in that The US should follow Europe and have a child must wear a mask at an older age but as it is the crazy rule is from 2 and over. Dont like it no problem dont mask your kids and dont fly with them  I have compassion for anyone with a special needs child or adult, but if you dont follow the T&Cs of the carrier (which it seems the parents didnt do) then I the compassion is alot less. sorry but as just I make sure all my Visa's are in order and issued then if Im traveling with someone who needs special care Id also make sure to know the T&Cs and make sure they are followed

Now you guys can go on , Ive said my last. This wasnt a case of Anti-Semitism but sadly of 2 parents not following the rules or maybe not knowing them, although its hard to believe that parents dont know kids 2 and older must wear a mask and its not OK if the kid doesnt want to or is only a few months older then 2. And yes IMO its dumb to expect a 2 yr old to keep a mask on, so get the law/rule changed or dont fly with them And bear in mind the father claimed he didnt have to buy his daughter a paid seat. Well if she sis 2yrs and 3 months that means they flew done for their vacation back in early Dec and are just flying back from then, why do I feel they didnt fly down before she turned 2.

Man does ARROGANCE run in your family or only You and Dan

Did you listen to the whole conference, I would assume not otherwise you would have posted what I did and let folks know that the story out there was full of missing info or is it you already drew your conclusion and thusly nothing wont change it. I did say I believe that as it was unfolding that I held by what the couple said, but the wife basically shot it to heck when she spoke and finally filled in the missing blanks. Personally I dont get how the lawyer didnt properly prep them at least on what to say and not to say.

Can you please inform me where yesterday you knew that the boy was playing the phones on full volume load at that, or that both kids werent wearing any mask at all it seems in the airport especially the daughter or where they claim they notified the carrier according to its T&Cs of their sons condition, rather then 'Cant you see my child is unlike most others'. lastly is a child 2 yrs and 3 months in your opin a child that just turned 2

I apologize for posting once again but felt it necessary

If you didnt listen to the so called live news conference the liar (lawyer) said it was being recorded, I highly suggest you listen to it especially when the wife near the end speaks up.

What I learnt and wasnt mentioned before she spoke: and none of the FAs INMO were anti, including Daryall the male FA, who didnt fly in the end.

1- she said the FAs were eyeing them by the gate and when they entered the plane Dayrall was standing there and asked her to put masks on BOTH kids, she answered she didnt have any and he gave her 2, means the kids werent wearing them anywhere in the airport.

2- it seems Spirit has in place  T&Cs if you are flying with a Special Needs person/child. And that simply showing up and claiming 'Special Needs' isnt in the T&Cs, why do feel they Never did any of the required notification. (not in the call just something I read elsewhere).

3- it seems she says she loaded 3 cell phones so her son could have what to listen to which she said he has to do at Full volume and the FAs asked that they lower the volume and they said her son decides on the volume and needs it loud.

4- she said what should we do go away and leave him home alone. I would tell her either stay home or drive its obvious you cant fly with your kids as they are.

5-  the liar (lawyer) said they werent interested in $$$ only by Midnight to hear from Spirit Im Sorry and to instruct their crews how to do things, when pressed by 1 questioner he didnt rule out suing, seems he just wanted to stack the deck for the suit.

So she admits the kids not only werent wearing a mask, the boy is understandable but it seems the girl was 2yrs 3 months at best and I disagree with the husband thats NOT just turning 2 the liar was the one who said her age on the call. Never said they notified the airline of the special needs son as required. All adds up to the FAs doing what they should have and didnt do any of it due to the family being Jewish or Religious

Try to listen to the recording, sometimes it takes awhile for the truth to finally come out although Im sure the liar now wishes he never had the conference or that those who listened didnt do so as carefully as I did

Now Spirit did drop the ball on its 1st comment, but I place the blame on the parents on this one.

I cant remember the last time I said this but I tip my hat to Dan, for knowing his kids wont remain masked and thusly wont fly with them at present, that is the correct way

Glad to hear you had a successful conclusion to this journey  :-\ (albeit a different journey than we all were expecting!)
Can anyone advise- am I supposed to file a SEPARATE DoT complaint against Etihad and Chase? Or just select Etihad as the airline and then mention Chase in the actual complaint? Or just file one against each separately? TIA!

Personally we filed 1 Complaint and listed just Chase since they were the TA and Etihad since they were the ones who issued the tkt and would be the party that has to do the Refunding.

Air Serbia was only the carrier you have flown, they have Absolutely nothing to do with getting a Refund issued.(side issue had you flown and a suit case was lost or damaged you would have filed against Air Serbia and not Etihad since you never flew on Etihad)

seems m65 did 3 separate complaints I wouldnt since its better if theres just 1 complaint # that has to be referenced , by having just 1 when each party replys to DOT it all goes into the same file and DOT can see what happening very easy. Different #s then DOT has to keep track of each and go back and forth to compare notes if need be, make it easier for them. m65 can answer if the same agent of DOT was working on all 3 complaints, I wouldnt want 3 different agents working on it

Make sure you mention that JU, Air Serbia CXed your flight and put in the flight #s and do mention that Chase sold you a code share flight w/o ever mentioning that they were selling you an Etihad tkt while you werent going to be on a single Etihad flight, something they were suppose to have made known simply looking at the flights even before purchasing, a Big NoNo according to DOT

I would not put in a complaint against Air Serbia, since they didnt issue the tkt nor sell it to you.Refund wise they arent involved whatsoever

Dis anyone get money back from Air Serbia?

Yes

I know I said I wouldnt post again but I hope what I post can help some of you get a Refund

Air Serbia tkts, the 1st thing is to check your original confirmation email from Chase (or whomever) see if it has the tkt# listed, if it doesnt call the OTA used and ask them for it

If the tkt# starts with 067 then its an EY(Etihad tkt and youre in luck) if it doesnt good luck

if your tkt is an 067 tkt, dont call, write complain to DOT about Air Serbia they have nothing to do with you and owe you Nothing, DO file with DOT against Chase and EY! if like others Ive helped at no time did Chase make known that in fact they were selling you a code-share flight include that to DOT as well.

Once you file it will take time to 1st get a DOT confirmation and apx 2 days later you will hear from both Chase and EY, EY will send you another email a few days later or week that they werent able to find your tkt are you sure it was booked with them. Reply with the tkt# from your 1st Chase email when you booked or that Chase told you the # was. EY will find it

Apx 1 month will go by from when you 1st hear from EY till you get your Refund, at least thats how it went down , unless they are used to the Air Serbia TLV flights and  work faster knowing they will Refund them anyways. Once Chase gets the AR/ARC from EY = they got their $$$ back then they will Refund your pts or pts & $s. In some cases Chase got the email from EY with all the needed info and Refund but didnt act on it on their side so once EY says they will take care of it you will have to call Chase again and ask them to go thru their notes and tell them EY claims they sent you the AR/ARC for a full refund and the Chase rep will find it and process it as you are on the line

At NO time tell DOT or EY that you want your UR pts, its NOT important, according to both EY & DOT a CC was used to pay for the tkt! dont drag UR pts into it as theres no way for EY to refund UR pts and you will simply confuse everyone!!!

Now as long as EY keeps flying into the US you have  a great chance of getting the Refund, if you werent tkted on EY stock bear in mind that Air Serbia is still not flying into the US and thusly under no pressure to refund anything even thou DOTs rules supercedes theirs. Your best bet after everything else fails is to get Air Serbia to extend your tkt till such time as they restart flying to NY or you can somehow make use of the funds for a tkt on them

I only hope this info helps as many get Refunded as possible (my plan is to go silent once again so I wont be responding to any posts made or PMs sent on this site , should you send a PM and include your email address I will respond regarding Air Serbia tkts only)

Hope I havent left anything out a Gutten Shabbos to one and all. Stay Healthy and Safe

yea its very convenient having a family member who is GS to use their upgrades. Also if using an upgrade on an ord-hnl flight is there a way to request a kosher meal if u have not been upgraded yet?

No

its worse then that, many times you will clear the UP after T-24 so then no way can the system request it. Maybe  a GS can pull it off Im not sure they could. I usually book according to what I can Confirm at time of purchase but have had problems when they switch things around with my flight times, a couple of times I had to go to the mat with them and get them to open up a Rev seat.

DEN/SFO/LAX/ORD-HI should also all have KSML in J/F.

Whether or not you will get it is another story, but that's the policy and it'll be good enough for a $200 ETC (got a couple of those when we last flew (IAH-HNL)

Thanks didnt know DEN,LAX or SFO was included now we can play who's the vendor! My last HI was pre 3/3 actually I think I had 2,  1/12 & 2/12. IAH-HNL I expected would have KSML. Now Im hoping my JFK-IAD remains at 4 Over and with only a carry-on find myself playing the VDB game. But its not 09 any longer and many a vastly Oversold flight in '12 went out taking on SBYs and flew with empty seats. So I dont count anything till the Fat lady sings and then to my tune ($$wise)

the cries of the Auctioners (GAs) have been deadly silent most of '11 & '12 thats for any flight.I cant remember when it was so dry for everyone

Thought all of that was relatively obvious but i guess not for everyone

You have to remember every site gets its fair share of newbe's who reads something and thinks they will dup it. Thats a big problem with Compensation and leads to alot more anger and salt being poured onto their wound.

Im sure theres a Comp thread somewhere on here and when someone doesnt get what someone got they do a war dance thinking they were short changed, they just didnt know theres differences up and down the line. So I erred on the side of caution and didnt want anyone spending their $$ at the tables of Airline Chance w/o knowing that to a large extent its stacked against them succeeding or better put it has its limitations in order to 1st beable to play

Just Shmooze / Re: Hebrew National being sued for not being kosher

knew I should have stayed off

A disclaimer, for those that dont know the only flights within the US that you can get a KSML on are JFK-SFO/LAX or EWR-SFO/LAX and EWR/IAD/IAH-HNL maybe also ORD-HNL not sure on that last 1. That said there arent any meals in coach, so you need to be in Biz (C) or 1st (F). That said the JFK-SFO/LAX flights you can only Upgrade on them using your miles or RPUs everyone earns the 1st 2 at 75k per year flown and 2 more every 25k after that. 1Ks earn 6 GPUs per year once they cross the 100k mark. That said the hardest free UPs (CPU) are EWR-SFO/LAX. And I expect to be flying back from ONT on that $52 fare in coach from SFO a PMCO 752 that arrives to connect to all of COs Intl flights, a CPU isnt in the cards

So please dont expect to reproduce what Ive been able to do, unless you are a 1K or GS the odds will be against you succeeding and I felt I should explain its not a Slam Dunk. So dont think hey I will fly NY-LA and pay $298 and get a $200 or x2 back for no meals or bad meals, in coach there arent any meals. yep That said the amount of the eCert depends on your status, so a Silver or Gold or Plat wont make out like a 1K or GS will.

And no Im not a GS and honestly I never will be since its based on Spend so buy $500,000 in ElCheapos you wont be invited to be a GS, yes its not something you earn but are invited to or you got to be lucky to be working for a compamy that gets some to give out as part of their corp contract

Its doable not easy and who knows what chages they will pull on us tomorrow. I just didnt want anyone getting back to me why didnt I explain it all now rather then after they started playing and found out the hard way

the above is in regards to COdbaUA only

im rly curious what do u do for a living

did you really think I would spell it out on a public BB? suffice to say Im no 20 or 30 something and been playing My Game way before there was a FT, played it extremely well on TWA and PanAm then again in those days AA,UA,DL,US didnt fly to many Intl places other then LGW and ORY. Gatwick and Orly in Paris thats correct they werent able to fly into Heathrow or CDG The playing field changed when PN sold its TPAC (Pacific routes to UA and before taking its final bow its TATL Atlantic routes to DL, and TW sold out to AA, things really started when TW sold its LHR to AA and PN sold to UA which a couple of yrs ago sold them to DL, which happen way before any Alliance existed but LHR which was slot restricted (still is, was worth its weight in Gold)and both PN & TW were heading nose first into the Ocean)

The best laugh I still get is when DL and NW walked away from JFK saying its not the place to be (they shared Term 2 together) and moved everything to LGA vowing NEVER to return well now DL is gonna be spending a billion+ on its new Term @ JFK with a big pressence there

Anyway Im off and would apprecaite everyones help in keeping me off by not attacking me especailly if you dont know what you are talking about.I wish you all a G yr of happy travels and many Miles and Points

Please do not PM here on this site I wont be able to reply as many know my handle on FT is craz PM me there and I will try my best to answer your questions and Help you in any way I can and yes when you show me I was wrong ,admit that to You as well,as Im far from being perfect

i always wondered how you choose which words to capitalize the first letter...

when I went to school I thought the teacher said, the last letter was the 1 to capitalize or its Ok as long as somewhere in what you wrote thers a cap. Comma and periods were a waste on ink or lead (any of you guys even know what a pencil is) Paragraphs were for those stuck up people  Yep gramma and speling (intended) was never my thing its mainly that I dont have the patience to proof read before Clicking Submit thusly ending up with teh or taht etc or many times I know what thoughts I have in my head (yes every so often my brain does slip back into work mode) but I dont end up typing it all and even many a time Im amazed at what I ended up posting

Hey if I was Chabad Id hang over there and could rely on it w/o any problem. Not being Chabad theres a problem for me and its AOK since its a MR for me and 3 nights of hanging. Since I hit it 2-3 times a year it worksout havent hit Kauai yet miss the Big I cant stand HNL But for what it costs me alot better then hitting MIA and ending up with no EQMs

that trip for $52 explain

Im not suppose to be posting people

My game is way different then 110% of you on here. Im not looking for something for nothing. My game is how to get something for the least $$ out of my pocket That something with UA is keeping my status

UA had a $160 fare NY-ONT(LA) for those who go after SPG status there are 3 cat2 @ ONT usually very cheap or C&P 1600 & $30 great place to rack up Stay credits on the cheap! So I had a $100 ecert (didnt include my MP# you dont want to accumalte too many ecerts at once and I had a few IFE and KSML problems on my KIX trip last yr) so that $100 cert brought the fare to $52 and my end of Feb SNA (Orange County LA) JFK-SFO-SNA-SFO-JFK with a $200 cert was $10 and its all confirmed in Biz and F

On FT when we say such a fare most of the regs know we are talking about using some type of a cert to get it that low.I Apologize for not having spelled it out here on this site and maybe gave some of you the wrong impression.

Now if UA had any brains they would make each Status level attainable only if X $s was spent as well or at least track each persons Spend , which would close my game down! I also think *S & *G s/b be 25k and 50k no matter what carrier its earned on, and each and every year

My Spend ($$ that UA got out of me ) was under $2k yet due to my status they think my spend must be $xx,xxx  so when things go wrong they take very good care of me.But unless you have time to kill (as I do) my game wont be yours But you can still check on a reg basis Mileage Runs on FT to see what if any interest you and works for you and be flex so when Im heading West I check fares into LAX,SNA,ONT,SAN,PHX,LAS out of LGA,JFK,EWR,PHL,BDL and before purchasing make sure you check car rentals Ive found cheap fares only to see the car is $200 more so its the total of air & car together that counts and for PHX and LAS add in the extra gas. and yes at times it was worth it to me to fly into LAS (JFK-SFO-LAS) and drive to LA then any other combo, besides why pass up a night or 2 in Lost Wages and talk about cheap Stay Credits

a person who plays as I do looks for flying like  < or > or ^ or v rather then a - (non-stop) trust me it adds up very fast eg NY-LA nonstop r/t is 4950 via SFO its 6150 do it often enough and that extra 1200 EQMs saves you a couple of trips every year, granted with the wrong woman  or with kids I wouldnt want to go any other way but non-stop. You wrote about a different DDF member who you saw there.

His shidduch chances could go down the drain now if he's still single. Otherwise, his kids can kiss a good shidduch goodbye. :)

It didnt even dawn on me,then again maybe it will Help them, since if someone will hold that against them do they really want to be with that kind of a person, I wouldnt want to.  But I will now edit out his/her handle

UpdateI just tried to Edit that post and seems this site still KOs that after x amount of time, so I RBPed it (asked by the Moderator link if they would be so kind and do so for me).

You'll still get $200 certs but this way when they do have your meal it will be halfway edible.
IAH-HNL seems to be a black hole for KSMLs in case you're short on vouchers.

Its IAD-HNL this Sun back on Weds cant stay Thurs night due to dateline question back into NY @3pm and then off to LA for Shabbos Fri @ 5am via IAH hey for $52 I couldnt hold back! 6k+ EQMs, my HNL return is yep you know it HNL-LAX-JFK It wouldnt have been so bad if it was the ps flight back to the left coast, but my friends already told me the other Shabbos they will fully understand if I bench after the soup and hit the hay, the problem will be explaining to the kids why  this time we cant play till Shabbos afternoon
