Rate Change: 

“Effective 3/30/08, AT&T will charge 20¢ for text/instant messages & 30¢ for picture/video messages sent or received on a pay-per-use basis. If you already subscribe to a Messaging Package or Media Bundle, there is no change to your rate. Existing customers will be notified via a bill message beginning with bill cycles closing on January 16.”

AT&T Contract:

“IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE, BEYOND THE LIMITS SET FORTH IN YOUR RATE PLAN BROCHURE, OR IF WE MATERIALLY DECREASE THE GEOGRAPHICAL AREA IN WHICH YOUR AIRTIME RATE APPLIES (OTHER THAN A TEMPORARY DECREASE FOR REPAIRS OR MAINTENANCE), WE WILL DISCLOSE THE CHANGE AT LEAST ONE BILLING CYCLE IN ADVANCE (EITHER THROUGH A NOTICE WITH YOUR BILL, A TEXT MESSAGE TO YOUR EQUIPMENT, OR OTHERWISE) AND YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE OR RETURNING OR PAYING FOR ANY PROMOTIONAL ITEMS, PROVIDED YOUR NOTICE OF TERMINATION IS DELIVERED TO US WITHIN THIRTY (30) DAYS AFTER THE FIRST BILL REFLECTING THE CHANGE.”

    I called and it worked nicely they put me on hold for a few minutes and said that it was ok and they will end my contract and that they hope I will stay ect.

    It doesn’t work.

    Last time, when they raised the price of SMS from 0.10 to 0.15 they said that you can only cancel a contract if they raise the price of something you subscribed to, not something which is pay per use.

    i think it was discussed in the comments on this website last time around

    I got rejected 2x. 1st one said it is not part of my contract, my contract is only for minutes not about text messaging so they can increase that.
    2nd one said, if you have a contract your text messaging rates do not increase they are locked in at 15 cents and will not go up to 20 cents.
    3rd time was on hold for 30 minutes, got to retentions, person kept putting me on hold didn’t know what to say. He asked for where it says I can cancel without ETF. Put me on hold again, went to talk to floor supervisor, supervisor said its a feature not part of contract. So no go.

    Seems like I’m staying with ATT. ANYONE HAVE ANY LEADS?

    worked for me-i just kept insisting that 15 cents sms is part of my contract and they noted on my account that i can cancel for free once my number is ported

    and if i do manage to get out of the contract with this (even though i have a messaging plan) any ideas of where to switch to (i need a plan with at least three thousand minutes and one blackberry)?

    Can I just cancel the contract part but keep the service and continue using at&t just without the commitment and then perhaps even get an upgrade sooner the I was supposed to?

    Moshe, when you call them to ask to cancel and keep your number, thy will put a note on your account, so you dont need to switch that day but i wont wait to long either.

    Try calling the after-hours department (obviously you must call them after hours). Sometimes they are a bit nicer. Their number is (866) 801-3600. I’m curious what the results would be.

    Didn’t work for me the last time either. I just paid the fee and was happy to be done with ATT (Cingular then). Sprint Sero is so much superior!
    And I was a very long time customer- from back when it was MCI! They couldn’t care less about keeping me as a customer.

    Tried doing it. They sent me to the manager. He said he received many requests regarding canceling because of the text messaging etc.. However, he said that text messaging is a feature which can be blocked. Therefore its not a breach in contract. However, once i called i complained about other things and told him i would like to change to sprint, so he gave me a $50 credit and an extra 1000 minutes.
